Acceptable Use Policy

Subscribers to the online services of New Mexico Technet are required to abide by the following Acceptable Use Policy (AUP). This policy also applies to network traffic incoming to Technet systems: Technet reserves the right to block traffic from sites which violate this AUP.

All Accounts:
E-mail and mailing lists:
Sending unsolicited e-mail, particularly commercial e-mail and bulk e-mail (addressed to multiple recipients) is prohibited. Automatic generation of mailing lists, or other inclusion of subscriber e-mail addresses in mailing lists without request or advance approval by the subscriber is prohibited. Mailing lists must be professionally administered and provide a reasonably responsive unsubscribe option, backed up (if automatic) by a reasonably responsive human list administrator. Forging of mail headers or otherwise obscuring or misrepresenting the origin of a message, either manually or via a mailer program, is prohibited. Technet reserves the right to block e-mail and other network traffic which originates from sites that habitually send or have recently sent unsolicited e-mail, or which permit e-mail to be relayed through them.

UseNet news:
Cross posting of articles (posting an article to several unrelated newsgroups), particularly for commercial purposes, is prohibited. Posting articles which do not fall within a particular newsgroup's charter is strongly discouraged. Forging of news headers or otherwise obscuring or misrepresenting the origin of a post, either manually or via a news program, is prohibited.

World Wide Web:
Technet reserves the right to refuse to provide World Wide Web publishing services using our servers and computers in cases where the content involved is judged to be salacious, explicitly erotic, or offensive. Customers purchasing transit services but not Web publishing services from Technet may establish whatever standards they feel are appropriate. Other prohibited content includes any illegal content as well as any content that supports or advocates violations of any clause of the AUP.

Violation of access or billing restrictions:
Violating or attempting to violate access and/or billing restrictions is prohibited.

Theft of service:
Technet subscribers are prohibited from using Technet services and resources to attempt or perform theft of services, whether these services are provided at Technet or elsewhere on a connected network, including the Internet. Theft of service includes but is not limited to: access violations (hacking/cracking), third-party e-mail relay (particularly bulk mailings), denial-of service attacks, and data theft. Technet maintains the right to block network traffic which originates from sites that probe or attack other systems on the Internet.

Leased lines:
Leased line and other transit service customers are contractually required to implement a similar acceptable use policy, and to make reasonable efforts to enforce it. Except where explicitly noted, all clauses of Technet's AUP should be represented by a similar clause and/or policy in the subscriber's AUP.

Other restrictions:
Users are prohibited from using Technet's services and resources to engage in illegal activities. Technet will cooperate with properly authorized investigation and enforcement agents in the course of any investigation of criminal activities.

Educational (pro-bono) Accounts:

In addition to the restrictions listed above for all accounts, the following policies are in effect for educational accounts provided at discounted or pro-bono rates for the educational community in support of Technet's educational mission:

Web Pages:
Web pages provided free to the K-12 educational community are intended to be used in support of teaching. They shall not be used for commercial purposes or contain material inappropriate for minors.

Educational (subsidized) leased lines:
Leased lines or other transit service purchased at educational rates shall not be used to route non-educational or commercial traffic. Providing transit service for additional educational sites is permitted only with prior notification and prior approval from Technet.

Penalties:

Violations of the AUP by a subscriber may result in mandatory training for the purpose of explaining, enforcing and correcting violations. Other possible outcomes include discontinuance of service, cancellation of accounts without refund, assessment of fees for lost, stolen or misappropriated services, and assessment of legal fees and/or collection fees.

Other Policy Issues:

Right to privacy:
Technet considers user-produced data stored on its servers or crossing its network to be the property of the subscriber who created it. The degree to which this content is made public is under the sole discretion of the creator. Contents of this data will not be reviewed, edited, archived without notice, replicated or otherwise investigated or altered in the normal course of business. Technet reserves the right to do so in the process of investigating system malfunction, resource abuse, illegal activities, or AUP violations.

Resale of collected data:
Demographic and personal data provided to Technet by subscribers will not be distributed, sold, or given to any other organization without prior notification of the individuals referred to by the data. Please see Technet's Privacy Policy for more information.

Editorial control:
Technet does not exercise editorial control over the content of e-mail, chat sessions, Usenet news postings, web pages, or other content produced by Technet subscribers. Subscribers are solely responsible for such content. Enforcement of Technet's AUP is performed only after noncompliant content is brought to our attention; Technet exercises no proactive monitoring or editorial oversight at the time of content creation, publication or transmittal. Technet's editorial oversight is restricted solely to company-generated, official content. There are remedies for those who believe themselves to be victims of copyright infringment. Liability limits:
Technet's legal liability is strictly limited to items over which it retains editorial control.

New Mexico Technet abides by the Uniform Domain Name Dispute Resolution Policy as defined by the The Internet Corporation for Assigned Names and Numbers (ICANN). We also stipulate that all domain registrants with us read, agree to and abide by the TUCOWS Registration Agreement
